Threatening or harassing another Member is always unacceptable, regardless of language used. Violating
any
of these expectations will result in restrictions being applied to your Account which may include
permanent
termination and may result in a report being made to the relevant legal authorities.
10. DATA PROTECTION
Our Privacy Policy and our Cookie Policy, each as may be amended by us regularly, apply to your use of
the
Services.
If any applicable law or regulation requires it, or if we determine that such disclosure is necessary in
connection with any investigation or complaint regarding your access or use of the Services or User
Content,
we may disclose any information we hold about you including your identity to the relevant authorities.
We and/or our affiliates, licensors and licensees may market products and services to you, in accordance
with applicable law, our Privacy Policy and our Cookie Policy
11. CHEATING
You are responsible for how you and your Account are represented on the Platform. Cheating in any
fashion
will result in immediate action being taken by us, which may include suspension or termination of your
Account.
Exploiting other Members is an equally serious offense. Scamming, account sharing, win-trading, and
anything
else that may degrade the gaming experience for other Members is prohibited.
12. BEHAVIOUR
Behaviour that intentionally detracts from others' enjoyment (such as griefing, throwing, spamming chat,
etc.) is unacceptable. We expect our Members to treat each other with respect and promote an enjoyable
entertainment environment. In determining whether a Member's behaviour is acceptable, we may take into
consideration complaints made by other Members. We reserve the right to place restrictions on your
Account
and to refuse payouts of prizes if you fail to comply with this requirement.
While we encourage you to report Members that are behaving in a disrespectful manner, falsely reporting
another Member with the intent of restricting their account with us is also unacceptable and may result
in
restrictions being placed on your Account.
13. NAMING
Member Account names ("Handles") are subject to the terms of this Code of Conduct. Any Handle that you
choose must be appropriate, inoffensive, and not be otherwise objectionable. Any Handle that violates
our
standards or disrupts the community of Members must be changed. We reserve the right to place
restrictions
on your Account if you fail to comply with this requirement. In determining whether a Member's Handle is
acceptable, we may take into consideration complaints made by other Members..
14. TERMINATION
Termination by us:
You understand and agree that we may, at any time and with or without notice,
terminate your Account, and/or prohibit you from accessing the Services, in whole or in part, if we
reasonably believe that you have breached the Agreement. You understand and agree that we may take any
one
or more of these actions without prior notice to you. Should we take any of these actions, we may
deactivate
and/or delete any or all information about and concerning your account, including your registration
information, in accordance with our Privacy Policy. We will determine your compliance with this
Agreement,
acting reasonably. If you wish to appeal our decision, you may do so by emailing
support@threesixteen.io,
setting out the grounds for your appeal. Any violation of this Agreement may result in restrictions on
your
access to all or part of the Services and may be referred to law enforcement authorities.
We may terminate the Services (or any part of them) or cease operating the Platform, or any Games if any
change in law or regulation or any threatened legal claim or any external business circumstances mean
that
it would be or may be in breach of any laws or third party rights or unduly risky to continue with the
Services or Game or Platform (as relevant), and we will provide you with as much notice as is feasible
of
such termination or cessation.
Further, we may terminate the Services (or any part of them) or cease operating the Platform without
giving
any reason.
You agree that we shall not have any liability to you or any other person for any termination of your
access
to the Services, and/or the removal of information concerning your Account in accordance with our
Privacy
Policy.
15.2 Termination by you. You may terminate this Agreement at any time, this can be done by simply
discontinuing using the Service.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall we, our parent company, our
affiliates,
our subsidiaries or our licensors be liable for any direct, indirect, punitive, incidental, special,
consequential or exemplary damages, including, without limitation: (i) damages for loss of profits; (ii)
goodwill; (iii) use; (iv) data or other intangible losses, that result from the use of, or inability to
use,
the platform, including unauthorized access to or alterations to your transmissions of data.
To the maximum extent permitted by applicable law, under no circumstances will we, our parent company,
our
affiliates, our subsidiaries or our licensors be responsible for any damage, loss or injury resulting
from
hacking, tampering or other unauthorized access or use of the platform or your account or the
information
contained therein.
Without prejudice to the foregoing, our liability to you however arising (and whether based on contract,
tort, negligence, strict liability, or any other basis) is capped at a sum equal to one month of the
then-current paying member fees.
This limitation of liability section applies whether the alleged liability is based on contract, tort,
negligence, strict liability, or any other basis, even if we or our licensor have been advised of the
possibility of such damage
16. COMPUTER ERRORS
To the maximum extent permitted by applicable law, this Platform and Our Content are provided on an ‘as
is'
and ‘as available' basis and we, our affiliates and business partners do not guarantee that: the
Platform
(or any part of it), or any of Our Content, will be uninterrupted or error-free; or that the Platform
will
be secure or free from viruses, malware or other harmful elements. If you become aware that the Platform
contains any error, or is incomplete, you shall immediately notify us by e-mail at
support@threesixteen.io.
You agree to refrain from taking any advantage whatsoever of that error or incompleteness and we reserve
the
right to recover any such advantage that you do gain from such error or incompleteness, as well as all
associated costs, damages, and expenses in making such recovery. We will not be liable for any Pay-out
Claims in respect of Prizes that we determine, acting reasonably, to be the result of a system error or
malfunction.
17. GOVERNING LAW
The existence, formation, interpretation, operation and termination of this Agreement and any matters or
disputes arising out of or in connection with them (whether contractual or non-contractual), are
governed by
and interpreted in accordance with the laws of Federal Republic of Nigeria.
The Courts of Nigeria shall have exclusive jurisdiction on any dispute (whether contractual or
non-contractual) between you and the Platform arising out of any of the Services or the Agreement. By
using
the Platform, each Member hereby waives any claim that he or she is not within the determined
jurisdiction
of said courts or that any of such suits is initiated in an inconvenient forum or improper venue.
18. DISPUTES RESOLUTION

19. MEMBER ELIGIBILITY & WARRANTIES SUBJECT TO APPLICABLE LAWS
You are subject to the laws of the country, state, city, or other legal entity (collectively
"Jurisdiction(s)") in which you reside and/or from which you access the Services. Access to the Services
may
not be legal for some Jurisdictions or for all residents of, or persons present in, certain
Jurisdictions.
We have installed filtering systems designed to limit access from known Excluded Jurisdictions.
It is your responsibility to comply with law in your Jurisdiction. The information contained in the
Agreement or on the Platform does not constitute an offer, solicitation, or invitation by us for the use
of
any of our services in any Excluded Jurisdiction.
We further reserve the right to require you to provide proof that you are eligible to participate on the
Platform at any point in time. We also reserve the right to refuse service and access to any potential
participant where we reasonably believe that such participant is based in an Excluded Jurisdiction or
has
otherwise breached or are likely to breach the Agreement.
20. PARENTAL CONTROL
Each time you access the Services, you represent and warrant to us that you satisfy the membership
eligibility requirements set out in these terms and conditions. All such representations and warranties
are
relied upon by us.
21. ENTIRE AGREEMENT
This Agreement (including any additional terms that we may provide when you engage with a feature of the
Platform), is the only agreement between you and us regarding the Services and supersede all previous
agreements, promises, representations, warranties and understandings between you and us regarding the
Services.
22. SEVERABILITY AND WAIVER
26.1 Severability
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or
unenforceable, such invalidity or unenforceability will not invalidate or render unenforceable any other
part of this Agreement, but the Agreement will be construed as not containing the particular provision
or
provisions held to be invalid or unenforceable.
26.2 Waiver
No changes to or waiver of any part of this Agreement shall be of any force or effect unless formally
posted
or made in writing and signed by a duly authorized officer of Three Sixteen Technologies Limited.
23. TRANSLATION INTERPRETATION
If you have translated these Terms and Conditions You agree that the original English text shall prevail
in
the case of a dispute.
24. CHANGES TO THESE TERMS AND CONDITIONS
We reserve the right, at Our sole discretion, to change or substitute these Terms at any time. If a
revision
is significant, We will make sufficient attempts to provide at least 7 days' notice prior to any new
terms
taking effect. What constitutes a significant change will be determined at Our sole discretion
By continuing to access or use Our Service after any revisions become applicable, You agree to the
revised
terms. If You do not agree to any new terms, entirely or in part, stop accessing the website and the
